Description
Claims and disputes are a constant in the construction industry, regardless of whether the industry is doing well or poorly. The number of claims seems to have risen during the recent recession despite the downturn (or perhaps as a result of the downturn) in the industry. This presentation, based on research conducted by the Navigant Construction Forum™, overviews some relatively recent trends related to construction claims and disputes in the areas of concurrent delay, suspensions of work, time extensions, notice and claim filing requirements, calculation of home office overhead, proof of differing site conditions and risk transfer in the design/build environment under Federal government contracts. Through this insight, it is believed that owners, design professionals, construction managers, contractors and subcontractors can devise ways to avoid such issues going forward thus making projects more successful, and more profitable, for all stakeholders.

Instructors:

Emily Federico is a director in Navigant’s Global Construction Practice. Federico is a certified Planning and Scheduling Professional (PSP) with 15 years of experience including proactive baseline and project schedule update development and monitoring from a technical and risk management perspective as well as the preparation and analysis of various schedule delay, acceleration, and loss of productivity and cost overruns claims on construction projects in the public and private sectors.  Federico has performed CPM schedule delay, productivity and damages analyses on projects ranging from buildings/ vertical facilities, such as schools/ universities, hospitals, retail buildings, transportation buildings and residential buildings, to highways and bridges and industrial plants.  Federico has provided expert testimony as well as litigation support for other Navigant experts.  Federico provides litigation support including assistance in preparing counsel for cross examination of opposing experts, mediation presentations, and preparing Navigant experts for trial and arbitration testimony.  Federico has provided numerous presentations to the construction industry regarding project scheduling, schedule delay and forensic schedule analysis.

Ben Woolley is an associate director with the Fairfield, CT office of Navigant Consulting, Inc.  His experience includes forensic analysis of construction projects in dispute settings, as well as proactive project risk management for active construction projects.  Woolley’s work includes Critical Path Method (CPM) schedule development and analyses including Baseline schedule development, interim project progress tracking and risk management, and forensic development of as-built schedules.  His work has included productivity and damages analyses including lost productivity, cumulative impact, design errors and omissions review, and forensic investigation of delay and disruption through contemporaneous project records.  This work has been spread across various types of construction, including apartment and dormitory buildings, high-rise residential and commercial building, underground utility and pipeline installation, waste water treatment plants, large-scale engineering and production programs, fossil and nuclear power plants, midstream natural gas processing plants, and government and military facilities.  Woolley has experience in both alternative dispute resolution and litigation. Prior to joining Navigant Consulting, Woolley completed his Bachelor’s Degree in Mechanical Engineering at Villanova University.  Woolley has been certified as a Project Management Professional by the Project Management Institute.
