Independent Contractor Law explained

On May 1 attorney general Martha Coakley issued a long-awaited advisory explaining the 2004 changes to the Independent Contractor Law and providing guidance on the attorney general's (AG) enforcement priorities. The advisory was developed with input from a broad spectrum of business groups, including ASM. The advisory makes it clear the AG's office will be looking primarily at an employer's relationship with individuals rather than with legitimate business entities, and as long as all individuals are employees of someone, there is likely no violation of the law. ASM will host a presentation by the AG's Office on June 2, to educate subcontractors on the law and the implications for construction businesses.
